UrbanVoice meets all the necassary CRTC requirements for Basic 911 service.
Please note: “you” means the customer and “Service” means Urban Networks Services.
VoIP Phone Service1. 911 Emergency Service Limitations Exist
The Customer must accept that the Customer's VoIP service has certain limitations in providing 911 emergency service including the requirement that you verbally confirm your specific location to an emergency services operator when you dial 911.
VoIP Connect 911 service works differently than traditional 911 services. It is important to familiarize yourself with these differences and limitations. Please see the Terms of Service outlined on www.VoIP Connect.ca/wps/portal/VoIP Connect for more information.
2. Security and Privacy Limitations Exist
Customer information and any other personal information of the Customer’s end customer is collected, used and disclosed by VoIP Connect only in conjunction with providing the Service to the Customer and in accordance with and for the purposes identified in the Privacy Policy available on this web site (https://www.VoIP Connect.ca/wps/portal/VoIP Connect/privacy_policy).
VoIP Connect utilizes the public Internet and third party networks to transmit voice and other communications. Urban Networks cannot ensure or guarantee privacy for all users of VoIP Connect. It is therefore recommended that VoIP Connect not be used for the transmission of confidential information. Any such use shall be at the risk of the Customer and its end customer and Urban Networks, its affiliates and its agents and suppliers have no liability in connection with such use. You and Customer further acknowledge and agree that certain privacy safeguard features including, without limitation, Universal Call Trace and Per Line Call Blocking, are not presently available with VoIP Connect.
3. Emergency Services – 911 Dialing
3.1VoIP 911 Consumer Tips:
The following list of "VoIP 911 Consumer Tips" is critical information that needs to be understood by both prospective and in-service customers: - VoIP Connect 911 service has certain limitations as compared with traditional E911; - When you dial 911 using VoIP Connect, you will be connected to an intermediate operator. This operator will ask that you confirm your location and will then transfer you to the emergency services agency that serves the area you have identified; - When calling for emergency help, you must be prepared to confirm your location and call-back number with the operator; - Your VoIP service (including the ability to dial 911) will be unavailable during a power failure or broadband Internet outage; - If you call 911, stay on the line until instructed to hang up; call back if you get disconnected; - You must ensure that you understand the 911 limitations of your VoIP service and that other potential users are made aware of these limitations.
3.2 Circumstances in Which 911 Service Would or Would Not be Available:
VoIP Connect Devices
VoIP Connect offers basic 911 service available only on VoIP Connect devices as described herein.
3.3 Service Outages - 911 dialing will not function in the following circumstances:
- Power Failure or Disruption - should there be a power failure or disruption, ALL Service and 911 dialing will stop operating until power is restored. The Customer may need to reset or reconfigure equipment prior to using the Service or 911 dialing.
- Broadband Service / ISP Outage or Termination / Suspension or Termination by VoIP Connect - service outages or suspension or termination of service by your broadband provider and/or ISP or by VoIP Connect will prevent ALL Service including 911 dialing.
- Service Outage Due to Suspension of Your Account - service outages due to suspension of your account as a result of billing issues will prevent ALL Service, including 911 dialing.
- Other Service Outages - any other service outage for ANY reason will prevent ALL Service, including 911 dialing. Such outages may occur for a variety of reasons, including, but not limited, to those reasons described elsewhere in this Agreement.
3.4 The Nature of the 911 Service That Is Provided And on What Conditions:
Possibility of Network Congestion and/or Reduced Speed for Routing:
Due to the technical constraints on the manner in which it is possible to provide 911 dialing for VoIP Connect service at this time, there is a greater possibility of network congestion and/or reduced speed in the routing of a 911 communication made using
VoIP Connect equipment as compared to traditional 911 dialing over traditional public telephone networks. Therefore, 911 calls may take longer to reach PSAPs or local emergency service providers than in the case of traditional 911 calls.
Automated Number Identification
One or more telephone companies other than VoIP Connect route 911 traffic to an operator who routes the call to the correct PSAP. Therefore at this time it is not possible for the PSAP and the local emergency personnel to identify your phone number when you dial 911, in order to call you back if your call is unable to be completed, is dropped or disconnected, if you are unable to speak to tell them your phone number and/or if the Service stops operating for any reason, including without limitation, those listed elsewhere in this Agreement.
Automated Location Identification
At this time it is not possible to transmit identification of your physical address to the operator who routes the call to the PSAP and local emergency personnel for your area when you dial 911. You will therefore need to state your location, as the operator will NOT have this information. Once you are transferred to the PSAP and local emergency personnel, you will need to state the nature of your emergency promptly and clearly, including your location, as the PSAP and local emergency personnel will NOT have this information. The operator and/or PSAP and local emergency personnel will not be able to find your location if your call is unable to be completed, is dropped or disconnected, if you are unable to speak to tell them your location and/or if the Service stops operating for any reason, including without limitation, those listed elsewhere in this Agreement.
3.5 Material Differences Between The 911 Service That Is Provided And Traditional E911 Service:
Non-Availability of Traditional 911 or E911 Dialing Service
The 911 service offered by VoIP Connect differs in a number of important ways (some, but not necessarily all, of which are described in this Agreement) from 911 or E911 emergency services as provided by traditional local exchange carriers. By activating the Service, you acknowledge that you have read, understood, and agree to the terms and conditions regarding VoIP Connect's 911 service.
Routing of 911 Calls
When you dial 911, your call is routed from the VoIP Connect network to an operator, who then asks for your physical location and phone number. The operator then routes your call to the Public Safety Answering Point (PSAP) designated for the physical location that you provided. The call may be routed to the general telephone number for the PSAP or local emergency service provider (which may not be answered outside business hours), rather than traditional 911 dispatcher(s). There may be a greater possibility that the general telephone number for the local emergency service provider will produce a busy signal or will take longer to answer, as compared to traditional 911 calls. VoIP Connect disclaims any and all liability or responsibility in the event that the information or routing is incorrect to the general telephone number for the local emergency service provider.
Failure to Designate the Correct Physical Address When Making a 911 Call
Failure to provide the current and correct physical address and location of your VoIP Connect equipment to the operator will result in any 911 communication you may make being routed to the incorrect local emergency service provider. The address information that you provide must be the actual physical street address where you are located, not a post office box, mail drop or similar address.
3.6 Measures That Should Be Taken By A 911 Caller As A Result Of Such Differences:
Alternative 911 Arrangements
You acknowledge that VoIP Connect does not offer primary line or lifeline services. You should always have an alternative means of accessing traditional E911 services.
3.7 The Obligation Of The Subscriber To The VoIP Service To Inform All Users And Potential Users Of The VoIP Service Of The Nature And Limitations Of The 911 Service:
Other Users
You agree to inform any household residents, guests and other third persons who may be present at the physical location where you use the Service, of the non-availability of traditional 911 or E911 dialing from your VoIP Connect service and device(s), and of the important differences and limitations of VoIP Connect 911 described in this Agreement as compared with traditional 911 or E911 dialing.
3.8 Applicable Limitations of Liability:
Limitation of Liability and Indemnification
Neither Urban Networks nor its directors, officers, employees affiliates and agents will be held liable for any claim, damage, or loss, and Customer and you hereby waive any and all such claims or causes of action, arising from or relating to any Service outage and/or inability to dial 911 from your line or to access emergency service personnel unless it is proven that the act or omission proximately causing the claim, damage, or loss constitutes gross negligence or intentional misconduct on the part of Urban Networks.
Customer and you agree to defend, indemnify, and hold harmless Urban Networks, its officers, directors, employees, affiliates and agents and any other service provider who furnishes services to you or to VoIP Connect in connection with this Agreement or the Service, from any and all claims, losses, damages, fines, penalties, costs and expenses (including, without limitation, reasonable legal fees and expenses) by, or on behalf of you or any third party or user of your Service relating to the absence, failure or outage of the Service, including 911 dialing and/or inability of you or any third person or party or user of your Service to be able to dial 911 or to access emergency service personnel, and any misroutes of 911 calls, including but not limited to your provision to VoIP Connect of incorrect information in connection therewith.
4. Warning Stickers
It is the responsibility of the Customer to provide warning stickers on ATA’s delivered to its end customers to identify the 911 does not work the same as a landline service.
5. Prohibited Uses
5.1 Unlawful
The Customer and its end users shall use the Urban Networks Service only for lawful purposes. Urban Networks reserves the right to immediately disconnect the Urban Networks Service without notice, if, in Urban Networks’ sole and absolute discretion, Urban Networks determines that Customer or its end user have used the Urban Networks Service for an unlawful purpose. In the event of such disconnection, Customer will be responsible for the full month's charges to the end of the current term, including, without limitation, unbilled charges, plus a disconnection fee, if applicable, all of which will become immediately due and payable upon disconnection of the Service. If Urban Networks believes that the Customer or its end user have used the Urban Networks Service for an unlawful purpose, Urban Networks may forward the relevant communication and other information, including the Customer’s identity and that of its end user , to the appropriate authorities for investigation and prosecution. Customer and its end user hereby consent to the forwarding of any such communications and information to these authorities. In addition, Urban Networks will provide information in response to law enforcement requests, lawful government requests, subpoenas, court orders, to protect its rights and property and where failure to disclose such information may lead to imminent harm to the Customer its end users or others.
5.2 Inappropriate Conduct
Customer and its end user shall not use the Urban Networks Service in any way that is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, or any similar behavior. Urban Networks reserves the right to immediately disconnect the Service without notice, if, in Urban Networks’ sole and absolute discretion, Urban Networks determines that the Customer or its end user have used the Urban Networks Service in any of the aforementioned ways. In the event of such disconnection, the Customer will be responsible for the full month's charges to the end of the current term, including, without limitation, unbilled charges, plus a disconnection fee, if applicable, all of which will become immediately due and payable upon disconnection of the Urban Networks Service. If Urban Networks believes that the Customer or its end user have used the Urban Networks Service in any of the aforementioned ways, Urban Networks may forward the relevant communication and other information, including the Customer’s identity and that of its end user, to the appropriate authorities for investigation and prosecution. Customer and its end user consent to Urban Networks forwarding any such communications and information to these authorities. 6. Incompatibility With Other Services
6.1 Home Security Systems
The Urban Networks Service may not be compatible with home security systems. The Customer’s end customer may be required to maintain a telephone connection through a local exchange carrier in order to use any alarm monitoring functions for any security system installed in the end customer’s home or business. The Customer and its end customer are responsible for contacting the alarm monitoring company to test the compatibility of any alarm monitoring or security system with the Urban Networks Service.
6.2 Certain Broadband, Cable Modem, and Other Services
The Customer and its end customer acknowledge that there may be other services with which the Urban Networks Service may be determined to be incompatible. Customer and its end customer agree that some providers of broadband service may provide modems that prevent the transmission of communications using the Urban Networks Service. Urban Networks does not warrant that the Urban Networks Services will be compatible with all broadband services and expressly disclaims any express or implied warranties regarding the compatibility of the Urban Networks Services with any particular broadband service.
